It was definitely high but didn't hit the head so yeah maybe a penalty would have calmed him down. I don't really understand deep kick offs as what do you really gain? When you have someone running full pelt at you it means you need to tackle quite high anyway.

Clear difference between a dive from there and what you are referring to. That said, no idea why he did not.
