The GOP's donors/paymasters know that Trump is cooked. He's no longer any use to them for gaining political control and legislating favourably for the wealthy and their corporation, however, there's still a substantial portion of the Republican base that's still very invested in the Trump personality cult. So they need the trusted propaganda engines like Fox to start undermining him in the eyes of the loyal viewers (voters).
His staff are showing him the same degree of loyalty he has shown to, well, basically everyone throughout his life when that person is no longer of use to him.

This is a different proposition to other culture wars stuff; affirmative action/positive discrimination cuts across the lives of a lot of people who aren't just flat out racists, looking for an excuse to bitch.
For example, I knew a guy in the SF PD, he worked his way up the ranks & was a good cop, but after losing out twice in the promotion panels to candidates who didn't come close to him, he just said fuck it & took early retirement. I don't think any reasonable person would consider it unnatural to be pissed off at a situation like this, unless they also think that women shouldn't be pissed off at their glass ceiling, or being denied equal pay, for equal work. Multiply that out by several million, & you have why this decision will get a different reception than that the Democrats may prefer.
I agree that a much better approach is to just focus on the inequality of opportunity, which is something America always pride itself on, & ditch the focus on race.

I know you probably mean legal basis, but I'm not sure that really matters. The Republican Justices are well aware of what the party/donors want and will find whatever they need to make a pretense at legal justification.

Of course he isn't the only person testifying under these conditions, so if say Eastman throws him under the bus in his testimony, & Rudy throws Eastman under the bus in his, & Smith has other evidence that doesn't come from a co-conspirator, they're both screwed.
